No purchase or payment of any kind is necessary to enter or win and will not increase your chANces of winning. MANY WILL ENTER, FEW WILL WIN. YOU HAVE NOT YET WON. SWEEPSTAKES IS ONLY OPEN IN CERTAIN STATES OF THE UNITED STATES.
Eligibility: This Sweepstakes is only open to COUPLES WHO ARE ENGAGED, ARE legal residents of the contiguous united States or the district of columbia (excluding alaska, hawaii, guam, puerto rico, and all other united states possessions and territories), AND 21 years of age or older AT THE TIME OF ENTRY. You are not authorized to participate in this Sweepstakes if you are not engaged, 21 years of age or older, and located within and a legal resident of one of the states in the contiguous United States or the District of Columbia at the time of entry. Anyone who after January 1, 2009 was or is an employee, officer, director, consultant, contractor, shareholder, representative, or agent of American Golf ("Sponsor"), or its golf courses, parent companies, divisions, affiliates, subsidiaries, franchisees, fulfillment, advertising, publications, promotional, and marketing agencies, legal counsel, website providers, webmasters, and its and their related companies and anyone involved in the development, production, distribution of materials for, and coordination of this Sweepstakes and the members of such individuals' immediate family or household are not eligible to participate. For these Official Rules, "immediate family" means parents, siblings, children, spouse, and persons living in the same households of each (whether related or not). American Golf will not accept submissions from wireless domains, blacklist domains, or any email address American Golf deems to be potentially harmful to the http://www.countryclubreceptions.com website.
How To Enter: You may enter the Sweepstakes in any of the following ways: (i) online by visiting http://www.countryclubreceptions.com (the actual entry form is at http://www.countryclubreceptions.com/forms/sweepstakes2)and following the instructions to complete the online entry form by providing your full name, city, state, and zip code of your home address (and optional street address) (P.O. Boxes are not permitted), email address, and telephone number (including area code); or (ii) by hand printing your full name, city, state, and zip code of your home address (and optional street address) (P.O. Boxes are not permitted), and telephone number (including area code) either on a postcard or separate piece of paper no larger than 8½” x 11,” and mailing the postcard or separate piece of paper to: “Country Club Receptions’ Perfect Proposal Sweepstakes Entry,” 2951 28th Street, Suite 300, Santa Monica, California 90405 (Limit one (1) entry per Participant. “Participant” is defined as both members of a couple that meets the entry criteria). Mail in Participants must have their entries postmarked by October 31, 2010 and received by November 5, 2010. Entries without ALL of the required information are void. When you enter at http://www.countryclubreceptions.com/forms/sweepstakes2 you will be asked to confirm that you have read and agree to these Official Rules. In order for online entries to be valid, Participants must click on the “I Accept” button (indicating your acceptance of the terms of these Official Rules) on the website. Further, by clicking on “Submit” to submit your online entry, you agree that you have read and agree to both these Official Rules and the applicable privacy policy referred to in these Official Rules. You will also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Sweepstakes. Neither consenting to receive future emails from American Golf nor answering the optional questions are necessary in order to be eligible for the Sweepstakes and neither will increase your chances of winning. The use of all information submitted on your entry is subject to the privacy policy posted on http://www.countryclubreceptions.com. Please refer to such privacy policy for important information regarding the collection, use, and disclosure of personal information by American Golf. As permitted by law and in accordance with Sponsor’s privacy policy, Sponsor may use information provided by entrants to send announcements about the Sponsor’s products and programs via electronic mail.
All entries must be received no later than 11:59 PM P.D.T. on October 31, 2010. Online entries are only valid if Participant had online access on or before May 1, 2010. Normal Internet access, phone, and usage charges imposed by your online or phone service provider may apply. Limit one (1) entry per Participant and one (1) entry per email address. Any person who has more than one (1) email address at the same domain may only use one (1) of his/her email addresses to enter. More than one (1) entry per Participant and per email address will be disqualified. Any attempt to obtain more than one (1) entry per couple by using different or multiple email addresses, identities, log ins, automatic entry software or any other method is prohibited and will result in disqualification. No copies, automated entries (including, but not limited to, entries made using any script, macro, or sweepstakes service), facsimiles, or mechanical reproductions will be accepted (including hand stamped entries or mailing labels). Online entries will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be requested to provide proof that s/he is the authorized account holder of the email address associated with the winning entry. Prize must be claimed and fully redeemed by April 30, 2011.
Prizes and Selection of Winners: A total of six (6) winners will receive a round of golf for four (4) persons, lunch for four (4) persons (excluding alcohol), and a one (1) hour wedding consultation at any American Golf premier golf course with catering facilities of winner’s choice. Certain restrictions may apply regarding the timing of the round of golf for four (at American Golf’s sole discretion). All portions of the prize need not be redeemed by winner on the same calendar day. Each prize has an approximate retail value of $575. Odds of winning depend upon the total number of eligible entries received. One (1) winner will be selected for each month during the Promotion Period from all eligible entries received. Winners will be selected in a random drawing and notified via email and/or telephone (using the information from Participant’s entry) after each random drawing. In the event: (a) potential winner(s) cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the Participant’s entry, (b) of noncompliance with any requirements within the applicable time periods stated in the Official Rules, (c) potential winner is found to be ineligible to enter the Sweepstakes or receive the prize, (d) potential winner cannot or does not comply with the Official Rules, (e) potential winner's prize notification or Affidavit is returned as undeliverable for whatever reason, or (f) potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Sweepstakes and an alternate potential winner may be selected by random drawing, at Sponsor’s sole discretion, from among the other eligible entries received. Winner selection is under the supervision of Sponsor, whose decisions are final and binding in all respects. If Participant's email address, telephone number, or home mailing address changes after he/she enters the Sweepstakes, it is the Participant's sole responsibility to notify Sponsor by postal mailing notice to the address stated below to be received before the end of the Promotion Period. Only a maximum of five (5) alternate Participants will be contacted to award any prize; afterwards, such prize will not be awarded. No substitutions or cash alternatives will be given in lieu of prizes except at the sole discretion of American Golf. No assignment or transfer of prize is permitted. The first random drawing date is scheduled for on or about June 1, 2010 and will be held monthly thereafter for the remainder of the Promotion Period, subject to change without notice in Sponsor’s sole discretion. All non-winning eligible entries will be retained for all subsequent monthly random drawings for the remainder of the Promotion Period. All federal, state, and local taxes and all other assessments are the sole responsibility of the winner. All additional costs, fees, and expenses associated with any prize not specifically detailed in this provision are the sole responsibility of the winner. This includes, but is not limited to, any travel (airfare, hotel, taxi, gas, car rental, etc.) expenses for purposes of winner’s redemption of all portions of the prize.
General Conditions: All entries are subject to verification prior to awarding a prize that all criteria, rules, regulations, terms, conditions and requirements in the Official Rules have been met. All winners (including both individuals of a couple that together comprise a Participant) will be required to execute and return within seven (7) days of the date printed on the notifications an Affidavit of Eligibility and Release of Liability/Publicity Release (“Affidavit”) (and all other documents required by American Golf). By acceptance of the prize and the publicity release portion of the Affidavit documents, Sponsor shall be permitted to use the winner’s (including both individuals of a winning couple that together comprise a Participant) name and likeness and to render their services (except where prohibited by law), including photo/video, and interviews (including media) in connection with this Sweepstakes, including promotion, publicity, and advertising purposes on behalf of American Golf, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval and without additional compensation. If the Affidavit documents are not executed and returned within seven (7) days of the date printed on the Affidavit notifications, the applicable prize will be awarded to an alternate winner. All guests of winner must also execute a liability and publicity release (unless expressly waived in writing by Sponsor) which shall be provided by Sponsor. Individuals who refuse to execute such liability and publicity release with no requested revisions shall be unable to be winner’s guest(s) for the lunch or golf portions of the prize. Submitted materials and the information therewith become the sole property of Sponsor and will not be acknowledged or returned. Proof of submission does not constitute proof of receipt. By entering, Participant accepts and agrees to these Official Rules, to upon winning execute all documents required by Sponsor, and that the decisions of the Sponsor shall be final and binding in all respects.
Grant of Rights: Participant irrevocably assigns and transfers all rights, title and interest in the entry to Sponsor, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all moral rights and all derivative rights) in and to the entry for exploitation worldwide in perpetuity, in all media and devices now known or hereafter discovered (including exploitation of an altered form of the entry, if Sponsor so chooses in Sponsor’s sole discretion), including for promotion, publicity, and advertising purposes on behalf of American Golf, without notice or review or approval and without additional compensation. Participant agrees to execute any documents that Sponsor may require to effect such transfer of right.
No Obligation to Use: Other than to announce the prize winners, Sponsor shall have no obligation (express or implied) to use any entry, regardless of whether or not a prize-winning entry, in any advertising, merchandising or promotion or to otherwise distribute, publicize or exploit any entry, regardless of whether or not a prize-winning entry, or, if commenced, to continue the distribution, publication or exploitation thereof, and Sponsor may at any time abandon the use of any entry, regardless of whether or not a prize-winning entry, for any reason, with or without legal justification or excuse, and neither Participant nor any other person(s) referred to in the entry nor prize winners shall be entitled to any damages or other relief by reason thereof.
No Infringement: The content of an entry must not infringe any person’s or entity’s rights (including, without limitation, intellectual property rights) in any way, including without limitation, the use, without permission, of any copyrighted material, trademarks, logos, company names, labels, symbols, store or building facades, music, photographs, works of art, or images that have been created, distributed, aired or published in any media.
No Illegal, Offensive, or Inappropriate Content or Names and Likeness Without Permission: Entries may not contain any illegal, offensive, or inappropriate content (as determined by Sponsor in Sponsor’s sole discretion) and unless express prior written permission has been obtained, an entry must not include any individuals’ names (other than those of Participant), in whole or in part, refer to public figures, or contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, living or dead.
Obligation to Obtain Third-Party Releases: If the entry contains any material or elements that are not owned by either member of the Participant and/or are subject to the rights of third parties, including, without limitation, Participant is responsible for obtaining, prior to submission of the entry, any and all releases and consents in writing necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who is mentioned in or is identifiable in the entry.
Release of Liability: BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AND PARTICIPANT’S FAMILY MEMBERS, GUESTS, INVITEES, REPRESENTATIVES, AND AGENTS AGREE THAT SPONSOR AND EACH OF ITS GOLF COURSES, PARENT COMPANIES, DIVISIONS, AFFILIATES, SUBSIDIARIES, FRANCHISEES, FULFILLMENT, ADVERTISING, PUBLICATIONS, PROMOTIONAL, AND MARKETING AGENCIES, WEB SITE PROVIDERS, AND WEB MASTERS, AND ITS AND THEIR RELATED COMPANIES, AND ALL EMPLOYEES, OFFICERS, DIRECTORS, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, SHAREHOLDERS, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS OF THE FOREGOING (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE RELEASED AND HELD HARMLESS AGAINST ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) INCLUDING WITHOUT LIMITATION, TO PERSONS SUCH AS PERSONAL INJURY OR DEATH, OR TO PROPERTY, ARISING FROM, IN CONNECTION WITH, OR RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM AWARDING, ACCEPTANCE, POSSESSION, MISUSE, MISDIRECTION, LOSS, OR USE OF A PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY, or any access to or use of the sweepstakes website or the downloading from and/or printing material downloaded from the sweepstakes website, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. WITHOUT IN ANY WAY LIMITING THE FOREGOING, This includes no responsibility to award any prize to participants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) participants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of a winner to accept the prize for any reason; OR (f) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similIar event beyond Sponsor’s control.
Limitations of Liability: Without in any way limiting the preceding provision, the Released Parties assume no responsibility for printing or typographical errors in any Sweepstakes-related materials; for lost, stolen, late, misdirected, damaged, incomplete, illegible entries, or for transactions that are lost or fail to enter the processing system, are processed, reported, or transmitted late, or are lost for any reason including computer, telephone, paper, or any other malfunction including human error; for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof.
The Released Parties are not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by web site users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. The Released Parties are not responsible for injury or damage to Participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the http://www.americangolf.com or http://www.countryclubreceptions.com web sites.
WITHOUT LIMITING THE FOREGOING, THE SWEEPSTAKES, ALL PRIZES, AND EVERYTHING INCLUDING MATERIALS PROVIDED ON THE HTTP://WWW.COUNTRYCLUBRECEPTIONS.COM WEBSITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
No Tampering, Right to Cancel, Modify: Sponsor reserves the right, in its sole discretion, to disqualify, without notice, any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes, or with any Web sites promoting the Sweepstakes; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple email addresses or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties (including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention) or unforeseen events or other causes beyond the control of Sponsor compromise the integrity or viability of the Sweepstakes, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or conduct a random drawing to award the prize(s) using all eligible entries received as of the termination date. If the Sweepstakes is terminated or modified due to such circumstances as described herein prior to the expiration date of the Promotion Period, notice will be posted on http://www.countryclubreceptions.com.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLDUING ATTORNEYS’ FEES) OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Disputes: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of California or the appropriate California State Court located in California; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes or participating in the Sweepstakes, but in no event attorneys’ fees; (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of laws rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Participants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have.
Winners' Names or Complete Official Rules: All of winners’ first names, first initial of last names, city, and state will be posted on http://www.countryclubreceptions.com on or about February 1, 2011 and will be provided upon written request. For the name of all winners and/or a copy of the Official Rules, send a self-addressed, stamped envelope to be received by April 30, 2011 to: Country Club Receptions’ Perfect Proposal Sweepstakes Official Rules and/or Winner, 2951 28th Street, Suite 300, Santa Monica, California 90405.
Other Sweepstakes: Please note Sponsor may be running similar promotions concurrently or in the future. Entry into this Sweepstakes is for this Sweepstakes only, and you must enter each of any concurrent or future sweepstakes separately, and in accordance with any rules, terms or conditions applicable thereto.
